Acceptable Use Policy

This Acceptable Use Policy ("AUP") describes rules that apply to anyone ("Users", "you") who accesses or uses the Airgentic service (the "Service"). By using the Service you agree to comply with this AUP in addition to the Airgentic Terms of Service. Capitalised terms not defined here have the meanings given in the Terms of Service.

1 Guiding Principles
Airgentic is committed to providing responsible, lawful and trustworthy AI‑powered customer interactions on public websites. You must use the Service in a manner that:

Complies with law in every jurisdiction where you or your end‑users operate;

Respects people by avoiding harm, harassment and discrimination;

Protects privacy and security of all data processed through the Service; and
-
Maintains system integrity, reliability and fair access for other customers.

2 Prohibited Content & Activities
You may not use (or allow others to use) the Service to generate, upload, store, display, distribute or otherwise process content that is:

Illegal or infringing: Any material that violates law, court orders, third‑party IP, or payment‑card rules.
Hate & Harassment: Content that attacks or demeans a protected class; slurs; threats; encouragement of violence.
Violence & Terrorism: Instructions for violent wrongdoing; praise, support or propaganda for extremist organisations.
Sexual Content involving Minors: Any sexual depiction of minors; sexual exploitation.
Adult Sexual Content: Pornographic or explicit content whose primary purpose is sexual arousal (educational or scientific contexts excepted).
Self‑Harm: Promotion of self‑harm, suicide instructions, or encouragement.
Fraud & Misinformation: Phishing, deceptive schemes, or knowingly false or misleading claims that could cause harm.
Personally Identifiable Information (PII): Unlawful posting or sharing of sensitive personal data without consent (e.g. credit‑card numbers, health info).
Malware & Hacking: Viruses, ransomware, exploits, or instructions facilitating unauthorized system access.
Spam & Unsolicited Bulk: Mass advertising, chain letters, or any content sent in violation of anti‑spam laws (e.g. CAN‑SPAM).

3 Security & Abuse Safeguards
You must not:

Attempt or encourage others to reverse‑engineer, decompile or extract source code, underlying models or proprietary algorithms.

Disrupt, overload, or interfere with the Service or any connected network (e.g. denial‑of‑service attacks, excessive API calls beyond plan limits).

Circumvent or attempt to bypass rate limits, authentication, usage caps or security controls, including prompt‑injection or jailbreaking attempts.

Access another customer’s account or data without explicit permission.
-
Probe, scan, or test vulnerability without our prior written consent.

4 High‑Risk & Regulated Use Restrictions
The Service is not designed or certified for use in environments where failure could lead to death, personal injury, or severe environmental damage (collectively, "High‑Risk Activities"). These include but are not limited to:

Medical diagnosis or treatment decisions;

Emergency response dispatch;
-
Critical infrastructure or safety‑critical control systems; and
-
Provision of legally binding financial or investment advice without qualified human review.
If you operate in a regulated industry (e.g. finance, health, insurance) you are solely responsible for ensuring that your use complies with sector‑specific obligations.

5 Data Privacy & Ownership

You must only submit Customer Data for which you have obtained all necessary rights and consents.

You may not submit protected health information, government‑issued identifiers, or other Sensitive Data unless your plan explicitly permits it and you have executed the relevant Data Processing Addendum.

You remain controller of Customer Data; ensure you have a lawful basis to process end‑user personal data through the Service
6 Export Controls & Sanctions
The Service and underlying technology may be subject to export laws and sanctions. You may not use the Service in or for the benefit of any country, organisation or individual subject to Australian, U.S., U.K. or E.U. embargoes or sanctions.

7 Reporting Violations
If you become aware of any misuse of the Service or violation of this AUP, please notify us immediately at contact@airgentic.com. We may request additional information to investigate.

8 Enforcement & Remedies

We may monitor use of the Service electronically or otherwise to verify compliance.

Breaches of this AUP may result in suspension or termination of access, removal of content, forfeiture of unused credits, and referral to law‑enforcement where appropriate.

We reserve the right to update filtering and safeguard mechanisms without notice to address emerging threats.

9 Changes to This AUP
We may modify this AUP from time to time. Changes become effective upon posting to airgentic.com/legal/aup. Your continued use of the Service after an update constitutes acceptance.
